Terms and Conditions of Click & Collect

 

 

1.        Information About us

1.1    This page (together with the documents referred to on it) are the terms and conditions on which 23 Wine & Whiskey supply the products (the "Products") listed on www.23wineandwhiskey.com(the “Website”) to you. Please read these terms and conditions carefully before ordering any Products from the Website. By accessing the Website and placing an order you confirm you are 18 years of age or over and agree to be bound by these terms and conditions and the Terms of Use policy set out on the Website.

1.2    The Website is operated by JKV IND LTD. JKV IND LTD is registered in England and Wales under company number 06676841 with its registered office address at 147 Hungarton Boulevard, Leicester, LE5 1DF

 

2.        Description and price of goods

2.1 Every care has been taken to describe and show items as accurately as possible. Despite this, slight variations in items may occur. We will be happy to help you with anything there is that you don't understand or you wish to obtain further information. You can do so by contacting our customer service team on customerservice@23wineandwhiskey.com or by calling us on 0116 285 6100.

2.2  Prices on the Website are the prices charged in store on that day. When you shop online you will pay the same price (excluding our online only promotions) that you would pay if you went to a Store to purchase your Products.

2.3  All prices are inclusive of VAT.

2.4  We endeavour to ensure that all pricing information on the website is accurate, occasionally an error may occur and products maybe mispriced. If we discover a pricing error we will, at our discretion, either contact you and ask you whether you wish to cancel or proceed with your order at the correct price or notify you that we have cancelled your order. We will not be obliged to supply any Products to you at the incorrect price.

2.5  Product images are for illustrative purposes only.

2.6  Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website. 

3.          Placing an Order 

3.1    To place an order on our Website you must collect the Products that you order from the Store address that is stated in your order and have a credit or debit card acceptable to us in your name.

3.2    If you register on the Website You will create a username and password which you may use whenever you shop with us. you must treat your username and password as confidential and must not disclose it to any third party. Please keep this information in a safe place because you will be responsible for all activities and orders made under your password and username. If you think that someone else may either know or be using your username and password, please contact us immediately by either emailing us on customerservice@23wineandwhiskey.com or calling 0116 285 6100

3.3   We reserve the right to decline a new customer registration, suspend / disable Your Account, not to accept an order or terminate your right to link to the Website under these terms and conditions.

4.           Our Contract

4.1   Once you have placed an order on the Website we will send you an order acknowledgement by email setting out what you have ordered with the in-store prices on the day of order. This is not an order confirmation or acceptance from us. A legally binding contract with you will only arise once we accept your order and process payment.

5.           Ordering

We will not be obliged to supply any Products to you at the incorrect price.

5.4   We reserve the right to adjust prices, offers, Products, Product specifications at our discretion at any time before (but not after) we accept your order. Where an end date is specified on any offer on the Website, it is intended as a guide only.

5.5   All Products are subject to availability. In any event that a Product is not available after you have placed your order we will contact you to inform you of this and issue you a refund for the unavailable Product(s). 

6.           Cancellations, Complaints and Returns

6.1   You cannot amend an order online after it has been placed. If you wish to change or cancel your order please contact our Customer Service Team as soon as possible on 0116 285 6100

6.2   In the event of a complaint please contact the Store concerned if it refers to a particular order, alternatively you can email customerservice@23wineandwhiskey.com providing as much information as possible about your order. All complaints will be acknowledged within 48 hours of receipt and you can expect a full resolution of your complaint within 72 hours. You will be informed in the event of any delay in resolving your complaint.

6.3   23 Wine & Whiskey from which you purchased your Products will provide either a full refund or replacement for any Product that is faulty if we are notified of the faulty Product within seven (7) days of your order being collected. This does not affect your statutory rights.

6.4   The return of Products faulty or otherwise will not be accepted seven (7) days after you have collected them.

6.5   In the event of courier retuning parcel after several attempts to deliver, 23 Wine & Whiskey will charge £10.00 admin fee and refund the difference. 

6.6   If we require faulty bottles to be returned to us we will arrange this with you at your convenience.  We will not be responsible for the cost of returning any Products returned unless they are faulty.

6.7   All refunds will be made via the Website only within three (3) to five (5) working days and not at a Store, however, our Store will be happy to assist you.

6.8   Proof of purchase must be provided to obtain a refund and Products must be returned to us in the same condition they were in when they were collected by you.

7.            Collecting Your Products

7.1   We will always aim for you to be able to collect your order within the collection slot we have agreed with you, but we cannot accept liability if we provide the goods for collection outside of this slot or do not provide all or any of the goods in your collection order.

7.2   Ownership of, and risk in, the Products will pass to you once you have collected your order. You should inspect your order at the time of collection.

7.3   We can only allow collection of orders from the Store address stated on your order using the order receipt email containing the order number and proof of your ID. If you fail to provide the order receipt email containing the order number and proof of ID our Store will hold the order for a further 24 hours before cancelling the order and issuing a refund to you, in this eventuality we reserve the right to charge you a £10 administration charge.

7.4   We do not sell alcohol to anyone who is, or appears to be, under the age of 18. Our Stores operate a challenge 25 policy therefore please do not be offended if you are lucky enough to be asked for proof of age. We reserve the right to refuse the collection if we are in any doubt of you being under 18. 

7.5   Your order will be held for a period of five (5) days, if after such time you have not collected your order a refund for the cost of your order will be issued to you, in this instance you will be charged a £1.00 administration charge. On occasion upon agreement with the Store orders may be held for longer than the five (5) days.

7.6   Due to licensing restrictions we can only provide alcohol for collection during the licensing hours that are within our collection times. These are currently 8am - 10pm Monday to Saturday and 10am - 10pm Sunday.

 

8.           What We are Not Liable For

8.1   We take every care to provide your order for collection, we cannot be liable for any indirect or consequential loss or damage or loss of profits or reliance you had in having the Products available for collection from us, arising out of our supply or failure to supply the Products to You.

8.2   Nothing in these terms shall in any way limit our liability for death or personal injury resulting from our breach of contract, tort or negligence or limit any legal rights you have as a consumer. 

8.3   The Products are sold to you on the basis that you are a consumer therefore we will not be liable for any special losses that you might suffer using, re-distributing or reselling the Products as part of a business.

8.4   With the exception of faulty Products or returns made in accordance with paragraph 5 (five) of these terms and conditions, we shall not be liable for any Products once they have been collected from us.

8.5   We and the 23 Wine & Whiskey will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control. 

9.           Use of Cards

9.1   If you find your card has been used without your authority please tell us within 24 hours of finding out. You must also tell your card issuer within the time limits you agree in your card scheme rules.

9.2   We accept all major credit and debit cards as well as Paypal.

10.           Waiver 

10.1   If we at any time during the term of a contract, to insist upon strict performance of any of your obligations under any contract or any of these terms and conditions or  to exercise any of the rights or remedies to which we are entitled under the contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. 

11.         Severability 

11.1  If any of these terms and conditions or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law. 

12.         Entire Agreement

12.1  These terms and conditions and any document expressly referred to in them represent the entire agreement in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

13.         Our Right To Vary These Terms and Conditions

13.1  We have the right to revise and amend these terms and conditions from time to time. Any changes we make to these terms and conditions will be posted on this page. You will be subject to the terms and conditions in force at the time that you order Product(s) from a 23 Wine & Whiskey. 

14.         Law and Jurisdiction 

14.1  Contracts for the purchase of Products through our Website and any dispute or claim arising out of or in connection with them shall be governed by the law of England and Wales  and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
